Welcome to Motor Sharks Jet Ski & Boat Rentals ("Motor Sharks", "we", "us", or "our"). By booking or using our services, including this website, you agree to the following Terms and Conditions. Please read them carefully before proceeding.

Motor Sharks facilitates recreational watercraft experiences, including jet ski rentals, private yacht charters, and specialty water tours throughout Miami, Florida. All rentals are subject to availability, safety compliance, weather conditions, and payment confirmation.

• Deposit: A non-refundable deposit is required at the time of booking to reserve your time slot.
   
• Balance Due: The remaining balance must be paid in full upon arrival, prior to service.
   
• Accepted Payments: We accept cash, credit/debit cards, and electronic transfers.
   
• Pricing: All pricing is subject to change based on seasonality, demand, or promotions. Final pricing is confirmed at the time of booking.

• Customer Cancellations:
   
  • Cancellations made more than 48 hours before the reservation may be rescheduled, or refunded (minus deposit).
     
  • Cancellations made within 48 hours of the scheduled time are non-refundable.
     
• Weather Cancellations:
   
  • In case of inclement weather or unsafe conditions, we will reschedule your experience at no extra cost or issue a credit valid for future use.
     
• No-Shows:
   
  • No-shows or late arrivals (15+ minutes) may result in loss of deposit and service slot without refund.

• Jet Ski Riders Must Be 18+
   
• Riders born on or after January 1, 1988 must present a valid Florida Boating License.
   
• Temporary boating certificates are available online. Instructions are provided upon request or on-site assistance is available 30 minutes before your reservation.

• All guests must attend a safety briefing and wear life jackets.
   
• Intoxicated individuals will not be allowed to participate.
   
• Operators must follow all instructions from the guides or captains at all times.
   
• Motor Sharks reserves the right to deny service to any guest who fails to comply with safety protocols or appears to pose a risk to themselves or others.

All participants are required to sign a waiver of liability before engaging in any water activity. This waiver acknowledges the inherent risks of watersports and releases Motor Sharks and its affiliates from liability in the case of injury, accident, or damage, except in cases of gross negligence.

• Jet skis are limited to one or two riders depending on the rental package.
   
• Yacht charters can accommodate up to 13 guests as per Coast Guard regulations.
   
• Larger parties may require prior approval and additional arrangements.

Guests are financially responsible for any damage caused to equipment or vessels due to negligence, reckless behavior, or failure to follow safety instructions. Charges may include repair or replacement costs.

Motor Sharks may capture photos or videos during your experience for promotional purposes. By participating, you consent to the use of your image unless you opt out in writing before your activity.

Motor Sharks facilitates recreational water experiences from various marina locations throughout Downtown Miami and Miami Beach. The specific departure location for each reservation will be communicated to guests after booking confirmation. Guests are responsible for arriving on time at the designated location.

To provide flexibility, availability, and a high-quality experience, certain services may be fulfilled by independent operators, including vessel owners and licensed captains, where applicable. These operators are responsible for complying with all relevant federal, state, and local regulations, including licensing and safety requirements.

Motor Sharks acts as a booking and coordination platform and does not directly operate or crew vessels. Responsibility for vessel operation, navigation, and on-water activities rests with the operating provider.

For experiences requiring a captain, the captain is assigned by the operating provider and maintains full authority over vessel operation and safety decisions, including navigation, passenger conduct, and weather-related determinations.

Guests agree to follow all instructions provided by the captain and crew at all times to ensure safety and compliance with maritime regulations.  Captains are not employees, agents, or representatives of Motor Sharks. 

Motor Sharks reserves the right to modify or cancel services, pricing, or availability without prior notice due to safety, weather, mechanical issues, or other unforeseen circumstances. In such cases, customers will be offered a reschedule, refund or credit.

These Terms & Conditions are governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved in the courts of Miami-Dade County, Florida.
